Terms of service

1. Introduction

Welcome to Reflect Day ("the App"). "The App" includes the Reflect Day web application (including when installed as a Progressive Web App) and the experimental Reflect Day terminal client. The App is provided as-is by an independent developer ("Developer", "we", "us") without any warranties or guarantees of any kind. By using the App, you agree to be bound by these Terms of Service. If you do not agree, do not use the App.

2. The Service

Reflect Day is a personal journaling application designed to help users record and organize their thoughts and experiences. The App operates without a backend server: it processes your data locally on your device and, if you enable sync, in your own cloud storage account. The App is currently provided free of charge.

The App is a writing tool. It is not a medical, mental-health, or other professional service, and nothing in the App constitutes professional advice of any kind.

3. Eligibility

You must be at least 13 years old (or the minimum age required to consent to data processing in your country, if higher) to use the App. You must also meet the minimum age required by Google to hold the Google account you connect.

4. Your Content

You retain all rights to the journal entries, media, and other content you create with the App ("Your Content"). Because the App has no backend, Your Content is never transmitted to us, and we claim no ownership of it and no license to it.

5. User Responsibilities

You are solely responsible for:

  • All content created, stored, or managed through the App
  • Maintaining the security of your device, your Google account, and your data
  • Remembering any encryption password you set — it is never stored, and content encrypted with a lost password cannot be recovered
  • Backing up your journal entries and data regularly (the App includes export features for this)
  • Complying with all applicable laws while using the App
  • Properly securing any API keys or cloud storage credentials you use with the App, and any costs you incur with those providers

6. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

The Developer makes no warranty that:

  • The App will meet your requirements
  • The App will be uninterrupted, timely, secure, or error-free
  • Any errors in the App will be corrected
  • Your data will be preserved or maintained without loss
  • Third-party services and APIs integrated with the App will function properly

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL THE DEVELOPER BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES (EVEN IF THE DEVELOPER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM:

  • Your use or inability to use the App
  • Any changes made to the App
  • Unauthorized access to or alteration of your data
  • Statements or conduct of any third party regarding the App
  • Any data loss or corruption due to technical issues
  • Any issues with cloud storage synchronization
  • Any issues with third-party services or APIs (including but not limited to OpenStreetMap, Open-Meteo, or Google)
  • Any other matter relating to the App

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for certain damages; in those jurisdictions, the above limitations apply to the maximum extent permitted by law.

8. Data Storage and Privacy

The App processes and stores your data in the following ways:

  • Locally on your device
  • In your personal cloud storage account if you enable sync features
  • Temporarily by third-party services when you use features like location, weather, or AI

The Developer does not have access to your journal entries or personal information. How data flows through the App is described in detail in the Privacy Policy, which forms part of these Terms.

9. Third-Party Services

The App integrates with third-party services such as cloud storage providers, location and weather APIs, and AI services. Your use of these third-party services is subject to their respective terms of service and privacy policies. The Developer is not responsible for the practices or content of these third-party services.

10. Modifications to the App and Terms

The Developer reserves the right to modify or discontinue, temporarily or permanently, the App or any features or portions thereof without prior notice. The Developer also reserves the right to update these Terms at any time; material changes will be reflected by updating the "Last Updated" date on this page. Continued use of the App following any changes constitutes your acceptance of such changes. Because your data lives on your device and in your own Google Drive, discontinuation of the App does not by itself delete your data, and you can export it at any time.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the Developer resides, without regard to its conflict of law provisions.

12. Severability

If any provision of these Terms is held to be invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions will remain in full force.
